Made to Pay Discharged BalanceWhat is the name of your state? PA I filed Chapter 7 about two years ago and included on the bankruptcy a balance I owed to a phone company. I sent them the letter myself, notifying them of the bankruptcy, but recently I had to start service with the company and was made to pay the balance because they claimed they did not get the letter. Even if this was the case, can they legally make me pay a balance listed on a bankruptcy? |

My response: Let's see . . . you file BK against me, and now you want service from me, again? The phone company didn't have to supply service to you. To them, you had an outstanding balance that they couldn't collect. But, you want service? Then you pay them! It's just that simple. IAAL |

| That makes no sense at all, even the phone company said that they couldn't expect payment for a discharged debt. Since when can they refuse service under the circumstances? |

They CAN refuse service when a debt is due... However, they CANNOT try to collect the monies owed... They are not trying to collect from you, they are informing you that a debt is due at the address where service is expected, and they are NOT providing service until the debt is owed...

Ussually what happens is that they make you give a deposit before giving you service once again, but they should not try to collect on the debt itself. |

| Forcing you to pay a discharged debt is against the law. As noted, they will usually charge you a big deposit under a new account number for new service.
