What is the name of your state? Louisiana

If a person is married, but has separate bills, bank accts and expenses that would support filing Chapter 7 or 13, does the spouse also have to file? If the person can file separate and apart from their spouse, how do they report joint liabilities, such as mortgage and car notes and insurance? There is also a post-nuptial agreement in effect, which states some of the debts are the sole responsibility of the person. Can this be used to support filing an individual bankruptcy claim?

You don't need any 'support' other than the amount of your debts to file for BK.

YES, you can file separately. On the forms, where you list assets, there is a column where you specify whether or not an asset is joint.

POST-nuptual ? Never heard of one of those.. but, in any case, I don't think it has any bearing anyway, it would be supported by the State and BK is Federal.

So, the mortgage payments can be listed in full, even though both names appear on the paperwork?
