Question

motion to vacate lien

What is the name of your state? CA

My question is similar to Contago.

In year 2000, we filed for BK and was discharged Dec. 2000. Last month my husband applied for an equity line of credit from his Credit Union. He was told that there was a lien filed for Bank of America by Eskanos law office before we filed for BK. this particular debt was included in the schd F of the bk filing together with Eskanos and B of A.

Since we didn't check our property for any liens, we never requested this lien to be vacated. There was some money collected from my property and distributed but everything went to the IRS and of course the lawyer trustee.

Anyway, can we file a moting to vacte this lien and if so how can we do it???
the lien is for about $7500? I would appreciate any help you can give me. By the way, we filed our BK PRO PER which I was told is 'by self'. Thanxxxx
