is my 401k protected?Ia. Unemployed for near two years. formerly mid manager @75k. Have run up xcredit card bills of 60k. Is my 401k and/or annuity protected if I file? I have approx 35k in home equity; how much do I keep. Thanks. |

| Every state has different exemption levels. You didn't say what state you're from. In Indiana, your retirement investments would be safe but only $7,500 in equity in your home would be safe if you filed alone or $15K if you filed with a spouse. But the exemption levels are different in the different states, so yours might be OK. I had heard that Texas had a million-dollar exemption level on homes, but I don't know that for a fact. |
