My Student Loan Didn't Get Discharge


What is the name of your state? CALIFORNIA


Hello, i just recently filed Ch.7 last October. While i was going through the whole process i heard that student loans are not guaranteed to get discharged through bankruptcy and if it does it depends on circumstances. Well, i was hoping that it will get discharged especially if i really didn't get to used the training that i went to school for (i know, im not trying to make some excuses). I was surprise when i got a bill from my student loan(FAFSA), reminding me about the ending of my forbearance that i filed last year. I called them and asked them how come i still have an outstanding balance and they told me that student loans are not dischargeable. So i called the Bankruptcy office and told them the problem and the lady told me that my best bet is to consult with an attorney and see what they can do with my student loan.

Is there anyway i could get rid of this debt? I mean, afterall that's one of the main reason i file bankruptcy is to get rid of "ALL" my debts!!!

Please i need some advise!!!!

How did you file bankruptcy? What is a "Bankruptcy office"? Did you not have a attorney file this in the first place?

In most cases, no. Student loans are not normally dischargeable under bankruptcy. However, there are numerous other options you have which can allow you to defer student loan obligations, and one of these is a deferral of payments in the event of severe financial hardship. It sounds like this could apply to your case.
