Need advice pleaseWhat is the name of your state? Washington State. My ex husband filed bankruptcy on bills that had both of our names on it. I was told about this from him just a short time before he filed (right at the deadline). He told me that I would be fine if he did this. The problem is I have gotten a phone call already from one of the creditors stateing I am now responsible because he defaulted. The thing is, he has our house because I signed it over in the divorce. I have nothing and I am just trying to get by, I cannot afford to pay these bills. I did sign over in the divorce papers that he was responsible for these bills but I hear that doesnt do a thing for me. My ex husband and I share custody so I do not have our 4 kids all the time but I do have them every other week and I have a hard enough time trying to get by on just day to day bills like electricity and phone etc. Is there anything I can do? | Unfortunately, Washington a community property state and his filing now means you owe all bills with your name on them. First, be sure to read up on BK law in WA. And then I'd find out the date of his Trustee meeting (341 meeting), which you can do by going on PACER (first thing that pops up on Google) with your divorce decree in hand. I don't know if it'll do good, but it's better than nothing. So sorry this is happening to you. |

| If he just filed you have time. You have 60 days from the 341 creditors meeting to file an adversary complaint with the bankruptcy court. Read your divorce documents over very carefully. Does it have anything in it referring to 523(a)(5) or 523(a)(15). If you are getting child support he cannot file on you personnally. You need to read the rules regarding the 523 issues. Most lawyers will give you an hour of their time to explain your options. I am going though this now in AZ with my ex. It is not easy, but your going to have to fight him NOW or pay his bills when they get dicharged. |
