I am up against a wall because I am forced into bankruptcy due to having been on worker's comp for over 7 months.I depleted my savings and IRA during this time since I was deep in debt (mostly credit cards) my work comp benefits were not near enough to keep me afloat.I had excellent credit prior to going on work comp. I am now released from work comp but had to find new employer due to bad situation at previous employer. I am working a commission only job and my income is very unpredicable but it is all I was able to find. My problem is I cannot afford the lawyer's fee to file chapter 7. I know that I can arrange a payment plan with the lawyer but in the meantime I am sure I will be harrassed by the creditors and until the total lawyer fee is paid in full the bankruptcy filing will not be started. I am already stressed to the max due to my situation which is not my fault. Also, to complicate matters I am planning on filing for early social security benefits soon since I will be 62 in August. This will further limit my income since I am only qualified to draw about $800 a month and can only earn $12,000 a year in addition to the S.S. benefits. I presently need at least $2000 per month just to pay my basic living costs ( car payment, rent, food, utilities, etc.) This does not include approx. $1000 per mo. in bills I plan to include in my chapter 7. Any sensible advice? Is it advisable to do a self filing to save money?
