need information


floridaonly U.S. law)?
when filing for bankruptcy is it not required to list all creditors?
I am a creditor for a couple I sold a business to & they have defaulted in paying, actually have never paid us @ all, have since closed the business & talen all of our equipment & will not respond to us... Is this considered Bankruptcy Fraud & is there something I can do? They have left us broke by not paying & can not afford our attorney right @ the moment

All creditors are supposed to be listed .
Have they actually filed for bk?

Yes they have filed & I did call the Federal Bankruptcy office in Tallahassee & they had advised me that We were Not listed as one of the creditors.
what is the best course of action we should take @ this time?... the bankruptcy was just done w/the courts the middle of january

I'd send a letter to the trustee assigned to the case stating your concerns and attend the 341 meeting of creditors.

When you say "done" do you mean "discharged" or "filed"?

Actually after in depth conversations & the fact that I contacted the debtors attorney, he stated that we were listed as a creditor & yet we never received any information regarding this, so we did not have notice of the 341 meeting which took place the middle of january.. I went to the clerk of the courts office got copies of all that we need, but now need to figure out how to get my collateral back?

You need to determine if, the collateral was turned over to the bk estate.
AT this point, you need a lawyer.
