Need More Advice


What is the name of your state? AL
IF I FILE BANKRUPTCY ON MY CC DEBT WHICH ARE ONLY IN MY NAME AND IS ONLY MY DEBT. WILL MY HUSBAND LOSE HIS GOOD CREDIT RATING. THE ONLY THING WE HAVE IN BOTH OUR NAMES IS OUR HOME. WE WILL BE KEEPING IT AND NOT FILING ON IT.
HE MAKES THOSE PAYMENTS.

Please read the red letters at the top of your screen.

Then you haven't given enough information to advice you well. Any joint credit pulled it will reflect on him and sometimes it has a tendency to get put on spouses report also but you can contact them to have try and fix that but the house loan will say in bankruptcy on his credit also.

You have to include all debts when you file so the mortgage would be included and you may have options of reaffirming. Depending on what chapter you are filing and what kind of equity you have and other issues bankruptcy may or may not be a choice for you.

Please - Do NOT type in ALL CAPS - its the equivalent of shouting and its also quite hard to read.

You cannot exclude debts. You have to list the house on YOUR paperwork since your name is on the mortgage. Yes, you can reaffirm and keep it, but you can't exclude it. You can make sure that your DH's credit reports notes that HE did not file bankruptcy, only you did.
