Question

pa statute of limitations


What is the name of your state? pa. what is the statute of limitations to collect on a debt once it has been charged off? also how long can they wait to execute on a judgement once judgement has been entered? my understanding was 2 yrs from date of charge-off status and 5 years to make phone calls to try to collect the debt. can you tell me what section of the pa code you found this in as well

There is no SOL for COLLECTING on a debt, in theory they can try to collect forever. The SOL is for suing you to enforce collection. Once the SOL expires, they can't legally sue you to collect the debt.

The SOL's in PA are as follows:

Open Acct.: 4
Written Contract: 4
Domestic Judgment: 5 (writ of revival within 5 yrs.)


The SOL starts the first time you went delinquent and never again brought the account current. So if you made the last payment on 5/97, then it went delinquent in 6/97 starting the SOL -which then EXPIRES in 6/2001.

The PA statute for the 4 years is :
Subchapter B. Civil Actions and Proceedings.
§ 5525. Four year limitation.

As for a judgment, if no enforcement has taken place in the 5 years while the judgment is active, and it does NOT get renewed, then the debt is D-E-A-D. ONLY the entity that got the original judgment can renew it. Once that 5 year period for the judgment expires, they can't renew it.
