Question

PA vs. OH bankruptcy?


What is the name of your state? ca

I am currently living in CA but am moving back home to PA (parents) or OH (sisters home). I am just starting to research an upcoming bankruptcy...

I have very little property: clothing, books, videos, swatch-watches. I have about $20,000 in credit card debt and a few other smaller debts (about $1,000).

Is it better to declare bankruptcy in PA or OH?

I would suggest filing in Ca. for this reason. If you file in Ohio or Pa. there will be a 180 day residency requirement. The problem you could very well run into is the bk laws change while you are establishing residency. There is a very real chance that the new bk legislation will pass out of committee and will take affect 180 days after the President signs the bill into law. It'll make bk much more difficult, time consuming, and expensive. You don't won't to be stuck in a state and unable to file under the old law because you have not met the residency requirement.

leaving CA in less than two weeks...


Where is the best place to read up on the new BK laws?

And once having the 180 day residency which is better OH or PA?

If you have no assets to protect, there should be no difference in Ohio or Pa.
