What is the name of your state? Louisiana


If a cust. come in on 12/4 to get a loan then file bk 14 days later, do the Payday loan company have any rights even if the loan is unsecure. I read that if purchases or debt occur within 180 of filing you can't included it. Another question, at the 341 meeting, can a Payday Loan rep attend the meeting and not accept the terms of the agreement if this is the case. Is it necessary to have on the Loan application at time of the loan, I do not plan on filing bk within the next 180 days. Would this protect our company if we indicate this on the Loan application.

London, this is the second or third post where you've asked questions about the PayDay loan company you work for. Doesn't your boss/owner have an attorney? We can't keep acting as your company's "defacto" attorney when problems arise for your boss.

Tell him he needs to consult a local attorney.

Did I miss something, I have been reading the post for weeks. And from what I have read, if you have a question concerning Bk one can ask. But for those who must know, we don't have an Attorney, we do in house collection, which I'm one of the supervisor. If you have a problem with the questions, please feel free not to respond. I'm sure some other Senior member or other members with same problem would respond back. I'm not here to get smart or get smart remarks back. I would rather if you guys not respond at all. If what I have to say bother you guys pls by pass any messg with my name on it. I have reviewed several of your responds and seem to be helpful. Why are u pointing me out...Just don't answer. If i'm in the wrong forum please give me the right one. Only looking for advice not trouble nor smart remarks. If your answer to me is to get an Attorney then say that and leave it at that. Don't ask me why I"m here. I'm here for the same reason everyone else is here for "FREE ADVICE". That is the name of the forum unless it has changed. If you have a problem with PAYDAY loan companies then say that or don't say anything. If anyone who read my post have an answer for me, please reply.

Ladynred can you respond to my question, if you feel the same as the others I would understand.

When you post questions on behalf of your PayDay company, that constitutes commercial purposes.
It is not that we do not want to help you. The issue is one of simply following the rules of this website.

**A: Ok, I never use those types of services but I've seen them around. I got a Payanyday loan on one of my auto vehicles so I was confused.

Now I understand your respond, you don't like these type of places. Found this searching the forum...

While I agree that you must follow the rules and with the other Sr. Members here, I will give you one bit of information.

Your information that any debts incurred 180 days prior to filing cannot be discharged is incorrect. The general rule for non-dichargability is as follows:

"The following debts may be declared non-dischargeable by a bankruptcy judge in Chapter 7 if the creditor challenges your request to discharge them:

Debts you incurred on the basis of fraud
Credit purchases of $1,150 or more for luxury goods or services made within 60 days of filing
Loans or cash advances of $1,150 or more taken within 60 days of filing
Debts from willful or malicious injury to another person or another person's property
Debts from embezzlement, larceny or breach of trust
Debts you owe under a divorce decree or settlement unless after bankruptcy you would still not be able to afford to pay them or the benefit you'd receive by the discharge outweighs any detriment to your ex-spouse (who would have to pay them if you discharge them in bankruptcy). "

As for the rest of your questions as a creditor, I would suggest that you read the bankruptcy code yourselves if your company can't afford an attorney. Most of it is NOT that hard to understand.

Just for the record, I happen to think PayDay loan companies should be illegal and not allowed to do business .. there's a reason they are BANNED from operating in some states. I can get better loan rates from Tony Soprano !!

Now tell me how you can have me restricted when I see ever day you guys making comments that are not very nice. I didn't like what you said but i didn't threaten to have you restricted. If this board will restricted me for what I said to you then I need an Attorney. Once you told me about the rules, I understood and from now on I will follow them, but don't threaten me because of what I said rather wrong or right. The information I reported was what I saw in searching this forum, It may not be what was true but from what I read that is the way I took it and understood that was the reason you answered me back the way you did. So I moved on and asked for Ms. Ladynred to answer the question and gave her the option to answer or not. Please go back and see how she handled the situation even thought she agreed with you guys but presented it in a different way. You can tell me the right thing in the wrong way. What you were saying was right but how u said it was wrong. I'm sorry if i misunderstand your post concerning "Payday Loan" but don't threaten me of what you are going to do to me. Keep in mind you can't restrict ever user name that appear and what they may say that hurt your feelings. Please go back and read some of the posting some Sr. members have been outrages in their response and it was not necessary. As I mentioned before you have a choice to read my thread or not.

Again thank your for the information you gave on yesterday, and I will make sure I follow the rules of this forum...
