Personal BankruptcyNevada. Due to unemployment for 8 months, I fell behind in all my bills. I had all of these bills prior to my marriage this year. My wife owns our home & also a rental property. If I file bankruptcy without her, can they force her to sell either property?. Also, if they take into consideration her income to determine if I can file chapter 7, will they also take into consideration her debts as well? Thanks |

| Because you accumulated these debts before marriage, they are yours alone. Your wife can't assume legal responsibility for the debts or the payment of such. I sure wouldn't have any conbined credit with her till this matter is cleared up! |

| In addition, as long as the property in your wife's name was aquired BEFORE your marriage, it would NOT be considered community property, but her asset alone.. and the Trustee wouldn't be able to touch HER property for YOUR debts.
