Personal Prop Taxes?Owned a S-Corp, closed our retail store a year ago and filed personal bankruptcy. The corporation did not file bankruptcy. Personal Bankruptcy was finally discharged in Dec of last year. Now I'm getting bills for the Personal Property Taxes for the retail store for 2005 being due. There was no real property attached to these taxes. The S-corp has no assets. Are personal property taxes, when there's no real property involved, dischargable? Thanks. |

| Personal property is things like copiers, computers, chairs, desks, etc. Some cities or counties levy a tax on such items owned by businesses. This is the "personal property tax" for which you are receiving a bill ("real property" is land and the improvements). Since the property belongs to the corporation, such taxes are not discharged by your personal bankruptcy. Because you closed up shop, you may be able to file a return with the state/county showing that you have disposed of the property in question, which may stop future billings and/or eliminate liability for the tax. That's a local law issue. |
