Please please help! Bankruptcy in FL


What is the name of your state? FL

Hi. I am looking into banruptcy in FL, Chapter 7.

Do you have to do it with your husband or not?

DO they include the husband's income for the mean's test even though there is no joint accounts or anything?

We just bought a house 1 yr ago....will they make us sell it? It is in both of our names.

Bought a car a few months ago, can they take that?

I do not want to include the house or the car to be discharged. Can I do that? It is only credit cards and a past reposession of a vehicle that ex husband took off with and never paid. It was not may car. Same thing with credit card but I was the pri**** holder so they are after me.

I have just been served with a summons for a civil action agaist me for 10K for the credit card, what should I do? I dont own anything and cannot come up with the money! If I hire a lawyer to do the bankruptcy for me, am I on time? They gave me 20 days to respond.

You need to see a lawyer.
My understanding of bk reform is, household income is included in the means test. Also, if you owned the home less than 1215 days from filing, the equity is capped at $125K. {that may be exempted from creditor seizure}
You must list all creditors. The mortgage and the auto note holder but, you will be required to reaffirm if you wish to keep them.
