Previous bankruptcy


What is the name of your state? CA

I've previously filed a Chapter 7 and it was discharged in August of 1998. My husband and I have rebuilt out credit rating and were getting ready to buy and house this summer. While on maternity leave with our second child, my employer (whom I had worked for for 10 years) laid me off. I found another job after 9 months of unemployment but by now we are very far behind on our bills again. I have spoken with three different debt consolidation places but don't know if I can even afford the reduced payments. Someone advised us to file bankruptcy. Having done it before, I know how bad it was. I don't want to do it again. Anyway...my question is...legally can I even file again? and is so...how long in between? Thanks for your help.

Yes, you were eligible to file again August 2004 (as of the actual day you filed your last petition- ie: if you filed on the 18th in 98, then last August 18 was your marker)

Actually, you can file now. The current law is 6 years between filing dates. That'll change to 8 years on 10/17.
