Question regarding debt collectorWhat is the name of your state?ky I received a summons to court for a very old debt...not old enough for sol to apply, however. So, I called up the collection agency and made payment arrangements. I just received a letter stating that the judgement was rendered in favor of the plaintiff and that the plaintiff has agreed to withhold execution on said judgment( with the exception of a judgnent lien) so long as the def makes timely payments. I have decided to go ahead and file bankruptcy..probably chapter 13. I am currently allowing the above collection agency to deduct $100 per month from my checking. Will this be dischargeable? Thanks in advance for any replies. |

| Iep, you can discharge it assuming, it's not court ordered child support or student loans. |

| bigun, Thanks. It is not child support or student loans. It was originally a gas credit card account which was sold to the collection agency which resulted in the judgment against me. So, you are saying if i file bankruptcy, it will stop the automatic deductions from my checking per the judgment agreement? |

| Yes, filing bk comes with an automatic stay against all collection activity. |
