| RE-convert ? Did you start out with a Ch 7 and convert to a 13 ? Are you able to make your plan payments, have you missed any ? What are your objections to converting back to a 7 ?

re-convert chap 13 to chap 7yes, we started out chap 7 and converted to chap 13. we have been making payments, though some have not been for plan amount. what happens if chap 7 is enforced? is it possible to stay on chap 13 and have term/amount renegotiated? What are my options? |

| The Ch 13 plan CAN be modified, but it would have to be approved once again. What if Ch 7 is enforced ? Depends on your reason for filing CH13 in the first place. Was your mortgage in arrears ? Do you have too much equity in your home or too much in non-exempt assets ??

re-convert chap 13 to chap 7original filing had to do with mortgage being in arrears and debt load being too much. as for too much equity in house, i don't know, we have lived here for 8 years. how do i find this out? how can i determine if i have too much non-exempt? I appreciate your help. I am afraid that if chap 7 is enforced, everything will be lost and my family and i will be on the streets. |
