Reaffirmation

my wife and i had our bankruptcy discharged in july 03. included in our bankruptcy was bedroom furniture. it was a secured debt. the bank sent us reaffirmation paperwork before the discharge. we sent it back. we did the bankruptcy ourselves, no lawyer. we never had a reaffirmation hearing. we have been paying $25 per month on one peice of furniture. since we did not have a hearing and the creditor did not show up in court. do we have to reaffirm the loan and if we don't can the creditor take away the furniture.

Was it listed on your BK papers as a secured debt ??

Reaffirmation is NOT required in all states. If the court let it go by w/o requiring the reaff, then the debt was discharged. The catch is, you're still paying. If you stop - the creditor CAN repo the furniture but you can NOT be held responsible for any costs or balance left owing if they do take it.
