ReaffirmationWhat is the name of your state? Washington my wife and i had our bankruptcy discharged in july 03. included in our bankruptcy was bedroom furniture. it was a secured debt. the bank sent us reaffirmation paperwork before the discharge. we sent it back. we did the bankruptcy ourselves, no lawyer. we never had a reaffirmation hearing. we have been paying $25 per month on one peice of furniture. since we did not have a hearing and the creditor did not show up in court. do we have to reaffirm the loan and if we don't can the creditor take away the furniture. |

| Was it listed on your BK papers as a secured debt ?? Reaffirmation is NOT required in all states. If the court let it go by w/o requiring the reaff, then the debt was discharged. The catch is, you're still paying. If you stop - the creditor CAN repo the furniture but you can NOT be held responsible for any costs or balance left owing if they do take it.
