REAFFIRMATION, So Confused!!


Hi, I'm in Texas and have had 341 meeting of Ch 7 no asset case. We have furniture with Citifinancial (rooms to go) and they want us to reaffirm. Letter sent from our lawyer says to accept lowered amt. of 2150.00 (was 3450.00) at payments of 80.00 monthly but also states "Debtor hereby elects to reaffirm: the entire debt, in accordance with the provision of the attached agreement, except that any agreement with pre-computered finance charges is converted to an interest-bearing calculation of finance charges effective the date of this agreement." So 3450.00 was total due but with their hefty finance chgs. monthly pymt. was 212.00. So is this saying that they'll take 2150.00 at 80.00 monthly but will be adding finance charges of whatever amt? I'm not following. And what is our option here? My hours are being cut back even more in Jan. Should I send letter back to lawyer and surrender furniture? But it's my bedroom and living room furniture. Will have nothing? If I say we'll surrender is it possible they will not mess with it and let us keep? How would this affect our discharge which should be this next month? So confused. Thank you for your help!

What a nice person you are.. kicking someone when they are down. I only posted to find out what my rights are and what I need to do... I am quite seriously considering sleeping on the floor. But the same for my four children? I think you need to soften your heart a bit. You are an awfully mean person.

Your apology


Your apology is obviously not sincere. As for heart softening, put yourself in someone else's shoes. Have you heard of the Golden Rule perhaps "Treat others the way you want to be treated". Have a great life. I'll leave my post responses from here on out to those that really desire to help others with good information.

You buy furniture on credit, can't pay the loan and then you look for a legal loophole so that you can get free furniture and stick it to the bank. Yeah, that says it all about the kind of person you are.

leave HomeGuru alone, with almost 35k post, this person talks from the hip (short and simple).

I have seen you post the same question on numberous sites, still hunting for the right fit.

From what I have read you have three options: accept, redeem, or play their bluff.

If you can't make up your mind flip a coin: heads you redeem, tails you play the bluff and if it lands on the side you accept.


Good luck, and remember it only stuff. Also, if you went to some garage sales you could find half-way decent stuff for around $500.

I agree, it's easier to help those that try to help themselves. You obviously just recently made this purchased knowing you couldn't pay for it and hoping for a loophole in bankruptcy. I have gotten some really great stuff at estate sales and auctions. You need to learn how to live within your means. Large recently purchased furniture debt is not going to draw the symptathy or help you are looking for like a loss of job or medical bills or something that is beyong a persons control.

My advice is don't reaffirm, let them have it back. Take that 80.00 a month and buy something you can afford.
