Tax Levy & Ch 13


What is the name of your state? CA'

In a current BK CHp 13. Just rec'd lien to levy wages from 95, 99 and 2000. Besides from calling attorney, pay day is Friday and my boss needs something tomorrow. If they are included in the repayment plan can they still attach wages?

Who is "THEY" ?

The Automatic Stay protects you against all collection activities unless 'they' have asked for and been granted a relief from that stay.

'They' would be taxes. Levy from IRS claim 95, 99 and 00 did not get filed. My tax guy sent copies of 1999, 2000, and 95 in late February when ltr from State said they didn't get a claim for 2000. They (IRS and state) claim the tax return was not filed, thus we owe the money. I believe 2000 was E-filed, and 1999 sent certified. I spoke with them this morning (IRS) and they released the levy. We were moving a lot during 95 to about 00 so I had tax preparer just keep all copies for me so I wouldn't lose them in the moves....smart move for me....he keeps them anyway but I asked in advance & he didn't charge me for the copies he sent on our behalf..

Good move on your part having the tax guy keep them !

Still, if they're in the paln, they shoudn't be able to go forward with collection activities.

BTW - got your email and I answered it - but it bounced - 'user unknown" this happens every time I try to reply to you
Am I missing something ?
