| I am a law school graduate. What I offer is mere information, not to be construed as forming an attorney client relationship. Well, I hopw you have saved all of your payments that you didn't have to make due to the divorce decree. I hope there were balances stipulated to in the decree or court transcripts so that you can show where he kept spending after the decree. I hope the statute of limitations hasn't run out on you trying to collect it from him in some fashion (we know this is a pointless maneuver --- i.e. he IS filing bankruptcy), but it may serve to prove a point to some extent. Problem: if you both created bills together, you are still each liable to the creditor, court order or not. court order is more for either a defense on your part or to seek contribution from him. |
