| Rule 707a/707b..for sr. member What is the name of your state? Can rule 707a or 707b substantial abuse ,or good faith/badfaith be used by the trustee on the situation that I posted 6/25/2002 under the heading "investment and intent." I have been reading case law and it is unclear on what a trustee can or cannot do under these rules.It seems like some apply the rule to chapter 7 (to dismiss) even though it states in the law it can only be used in chapter 11,12, 13 cases. I think it said that they used the substantial abuse, bad faith, and the smell test. (The word unaposed comes up on thereruling) Do you have any thoughts on the ruling and could it apply to my case,where my goal all along was to make a profit and pay back all creditors...the trustee does have hundreds of papers of the stock transactions made in the 3 years of trading.
