sales tax debtWhat is the name of your state? Ny Im looking for some guidance. I recently closed my car lot (A DBA) about 8 months ago & now the problem is the sales tax people have come to my door & have given me 12 days to file 2 years of returns. All I want to know is the best way to get as much time to pay the $50000 I owe. And I dont want it to turn into a criminal matter. I havnt filed anything false, so no fraud. I cant go bankrupt on it but can I go chapter 13? Can I include in the plan to pay a lesser amount? Will filing stop interest & fees? I dont have the money. I just had a bad performing business, I wasnt trying to keep the money, just using it to get by & waiting for the business to turn the corner & it never happened. any guidance is appreciated & time seems to be of the essence Thanks Mike Edit/Delete Message |

| It's not just a tax you owe, it's a tax you collected and didn't pay over. The government hates not getting it's taxes, they really, really hate not getting the taxes you collected for them and then didn't pay over. I know that's not advice, it just helps put the situation into perspective. There are some attorneys/CPAs who specialize in sales tax issues. I suggest you find them. While I suppose it's possible to get a reduction on the amount owed, I've not heard of it. While sales tax does not have the exact same spine stiffining fear for all involved as trust fund taxes, it is different from regular income taxes and you need special help. In your attempts to further the time to collection, don't lie. Depending on the exact circumstances, a lie can be used to prove all sorts of intent as well as being a separate crime in itself.
