Secured loan acct. # change


What is the name of your state? WI

I just signed the papers on Thursday and the lawyer told me it will be filed either today or tomorrow. I have 1 secured loan that is currently 2 months behind and they are by far the most aggressive and rude in messages left on my machine. Anyway in Jan. they moved to loan to a different office and the loan number changed. This totally slipped my mind until I went through some papers and found the notice. The papers where filed with the old address and loan #.

I called and talked to the paralegal I have been dealing with, she told me that it's not a big deal it will be forwarded, etc. I'm not sure if she understood or heard me mention that the loan number was changed. Will this make a difference? I would hate to have this one not discharged, etc. I left her a message today with the new loan # and address, am I worrying about nothing?

Also the lawyer told me that because this loan is secured by small household goods, and wasn't used to buy a big ticket item, that it will be voided as a secured loan. This one bothers me because it's local, and they are very agressive after only 2 months of missed payments.

I did talk to the Paralegal about this, she has never seen a creditor change an account number because they moved it to a new office.

Anyway, she said that as long as I only have the 1 loan with them and the different account number isn't for a different loan then it all should be fine. She said we can make the change before the 341 meeting if we have to, she also said it might come back as being an invalid account # and that is when the change would happen.

However my concern is that they will discharge it all with the old loan #, and then CitiFinancial will come after me for the one with the new account # saying that it wasn't discharged. I do however want to talk to the lawyer before we go to the 341 meeting.

On the plus side(I think) Cititfinancial has stopped calling me when they learned(by me giving the lawyers name and #) that I am declaring BK.

I would definitely make sure that the new account number goes into the paperwork now, just to be on the safe side. Insist on getting it added so that there's no chance it will slide thru the cracks.
