Sought Lawyer ReliefWhat is the name of your state? NC I have posted before a couple of weeks ago. I have many credit card collections that I know I owe, but an illness has removed me from the workforce and can no longer pay my bills. My question today is: I have an appointment with a lawyer on July 1 that told me on the phone to not worry or stress over my situation, that he will help me. In the meantime, I have 1 credit card company that is sending paperwork to my county courthouse this week if I do not come up with a partial settlement NOW. Do I tell them I have a lawyer? Do I pay the partial to keep this out of court until I see the lawyer? I have always heard to not pay anything if you are in the process of filing BK, I just want to make sure I am doing the right thing. Thank you, Liz |

| Listen to your lawyer. I'd not pay anything. Nor, would I tell them about the bk plans. If all they are doing is filing a lawsuit, you'll be able to file bk and get the automatic stay well ahead of a trial date. Once you actually have a lawyer and, are in the process of filing, refer all creditors to your lawyer. Don't you talk with them at all. |

| Thank you, I was pretty sure that's what I should & should not do. So I should have the answering machine & caller ID on until I see the lawyer on July 1, right? |

| If you're planning to file a BK, you don't want to pay another cent to any unsecured creditors. You don't owe them courtesy or responses to phone calls. Merely hang up on any callers -- or don't take calls that aren't from a number you don't recognize. Once you file the paperwork, then they're not allowed to call you anymore. |
