statute of limitations


how long are the statute of limitions for a bounced check in north dakota. if there has been a warrant for arrest how long is it good for. what do you do when the statute of limitatioins has been reached to make sure that you don't get arrested. thankyou for the help.

Assuming it was a simple bad check charge (misdemeanor), they have 2 years to commence prosecution against you. However, the time that you are out of the state doesn't count against the two years.

Have you called to find out what the status of your case is at this point? Don't be afraid to call and ask. Most clerks will be happy to tell you what's going on with your case... it's not like they are going to trace your call and come to arrest you.

With that said, if they DID issue a warrant against you already, you could be arrested at any time in any state, depending on what type of warrant was issued. However, assuming it's just a bad check charge, ND is unlikely to go through the trouble of picking you up in another state (it would cost too much to transport you back).

If there is a warrant out for your arrest, I suggest you contact an attorney to fix the problem.
