Statute # for wildcard exemption Ch.7 - CA?What is the name of your state? CA Reposting because for some reason it shows the post as closed. For Chapter 7 bankruptcy form Schedule C - Property Claimed AS Exempt it has 2 choices: 11 U.S.C. 522(b)2 or 11 U.S.C. 522(b)3 Which do I check if I want to use the one that includes the wildcard? I have found many descriptions of both choices but none of them say whether they are 11 U.S.C. 522(b)2 or 11 U.S.C. 522(b)3. Can anyone help? Thanks. Gail L.What is the name of your state? |

Need actual title of exemption system that INCLUDES wildcardHi, I'm sorry, I did not make myself clear. I don't need the exemption statute for the wildcard, I need to know the title of the exemption system that includes the wildcard. 11 U.S.C. 522(b)2 OR 11 U.S.C. 522(b)3 There is a checkbox before each. Which do I choose if I want to use the one with the wildcard? Thanks. |

| The apology should be mine. I misread your question. The boxes are there to declare whether you are using state exemptions or federal exemptions. You don't have the option of using federal exemptions but you do have the option of using two sets of state exemptions. I am not experienced in the preparation of petitions in California. Someone with that experience should answer your question but I would imagine your don't actually have to declare which set you use because there is no place to do so on the form. Simply make sure that in the column where you specify which law you used for the exemption, you only use the 703 exemptions (which has the wildcard) and do not intermingle any 704 exemptions. Again, I strongly suggest you get an answer from someone familiar with the preparation of petitions in California. My answer is simply a best guess. Good luck to you. |
