Question

Still being garnished!!!


What is the name of your state? New York

On October 12 2005 I filed for bankruptcy. Before filing I was being garnished by one of my creditors. I get paid bi-weekly so I assumed that my next check (October 27) would be free of the garnishment. Just to ensure that my next check would be free of the garnishment I sent a letter, as soon as I got my notification in the mail of my meeting with the creditors (on October 19 2005)via certified mail to all of my creditors informing them of the case number. However, when I got my check today I noticed that there is still an attachment.
My question is am I eligible to receive that money back? Also what would be the proper steps to take to recoup the money?

Have your lawyer tell the trustee.

Some payroll systems are queued in a batch and it takes a week or two to make changes.

Can I recoup the money?


Yes but can I recoup the money that they took out after my BK petition was filed? Also, how can I go about recouping the money?

Tell your attorney and he can get it returned.
