Tax refund


Hi..I live in NV. I just received my discharge papers. I have heard that when you receive your tax refund it must be paid to the courts. Does anyone know if this is true?? if true, will the courts contact me to let me know. I know one person that was discharged, and did not have to pay the courts their refund. So not sure what is going on.

If you were ordered by the court to relinquish your refund when you received it, then you must do so.

If you get the check after the discharge and you were not ordered to pay it to the court, it's yours.

Now, go get caught up on some bills. ;-)

reply/ ???? tax refund


Thank you for your reply.
I haven’t received anything from the courts as of yet concerning tax refund. I don’t know
if they send a letter after the discharge, or if it would be included in the discharge papers.
Here is all my papers say.
1. the above named debtor is released from all dischargable debts.

2. Any judgment heretofore or hereafter obtained in any court other than this court is null
and void as a determination of the personal liability of the debtor with respect to any of
the following:
{a} debts dischargeable under 11 U.S.C. sec. 523
{b} unless heretofore or hereafter determined by order of this court to be
nondischargeable, debts alleged to be except under clauses {2} , {4} and {6} of 11
U.S.C.sec. 523 {a}
{c} debts determined by this courts to be discharged.

3.ll creditors who debts are discharged by this order and all creditors whose judgments
are null and void by paragraph 2 above are enjoined from instiuting or continuing any
action to act or try to collect such debts as personal liabilities of the above named debtor.
Date 11/21/01



I filed chapter 7. I can see nothing in the above wording that says I am to give to the
courts this year tax refund. But is it usual for the courts to put such an order in the
discharge papers, or would they send a letter around tax time???

Sounds to me like there's no reason for you to think that you owe the trustee (or your creditors) your tax refund.

Thank You...I just didn't want to use ANY of the monies, and six months down the road, I get a letter saying " we need your tax refund ".
