Tax Refund & Chpt 7 BK...


What is the name of your state? Indiana

If my husband and I file for chpt 7 bk (no assets) this month, how likely is it that the trustee will take our income tax refund for this year? We have two children and usually get to claim the child tax credit so we are used to receiving $2-3K back each year on our taxes..Dh works in construction so he's always laid off all winter and we use this money to catch our rent & utilites up with...I've heard that some states don't allow the trustee to take the earned income credit and/or child tax credit, but does anyone know if Indiana is one of those states?
We already have it set up to where we will see more on dh's paycheck each week rather then at the end of the year (took every exemption allowed), but we will still see a good amount for the child tax credit...
Any info on this would be greatly appreciated.
