Question

Tax Return


What is the name of your state?What is the name of your state? What is the name of your state?Georgia

Question:
If I file Chapter 13 and I don't have and IRS are Tax liens against me. Will the Trustee try to get his fingers on may Tax returns????

The trustee will probably want to see your tax returns and a lot of other documentation, especially if you are pro se. This isn't a matter of distrust -- pro se filers, especially in ch. 13, make lots of mistakes that the trustee has to straighten out, and they need lots of information to do that. The trustee will also want to take control of your tax refunds, when they arrive, because those funds are property of the estate.

Will the Trustee try to get his fingers on may Tax returns????

The Trustee kept my tax refunds when I was in my chapter 13. The refunds were released to me after the Trustee confirmed I was on a 100% repayment plan and that I was also current on the chapter 13. My attorney told me they would have kept the refunds if I wasn't paying 100%.
