Tax returnsWhat is the name of your state (only U.S. law)? Colorado We had filed for bankruptcy back in August and it just got filed with the court on January 22. I wanted to know if they are going to take our tax refund. I was told several different stories for people who have filed and the most common one is to spend it when you get it. Can you help me? |

| You need to ask your lawyer if it's property of the bk estate or not. A lot depends on the pratice of the trustees in your district and if you had enough exemptions to hang on to the refund. |

Tax returnsWhen you say lawyer you mean the Trustee right? Also, what do you mean by exemptions? We dont own anything...no car, no house, no property, nothing. Thank you for taking the time to help me. ![]() |

| Exemptions refer to property that your state allows you to keep in bk. By lawyer, I meant ask the lawyer who is representing you what will happen with any tax refund. |
