My parents were never legally married. In may of 03' my father used my mom's health insurance card at the dr's with her permission. In December of 03 they filed for bankruptcy and they forgot to file this dr. bill. In November of 04 my father passed away. We then found out that Virginia does not recognize commom law marriages. My mom is in the process of purchaseing a home and my fathers dr. bill is showing up on her credit report because he used her insurance. They will not take it off of her credit report. How long do you have after bankruptcy do you have to add something ? Is she reponsible for this bill?

Its been 2 years - its too late now.

It was her health insurance, she's liable for it. Even if that were not true, debts of the deceased are paid out of the estate thru probate. If your father left any assets, the bill would still have to be paid out of those assets.

What if he didn't have an estate? Her isurance fulfilled there portion and she did not sign anything saying that she would be responsibel for his bill.

She *might* be able to fight it, but generally if it was your insurance being used, you're on the hook for what's not paid by insurance.

Have you tried just sending a copy of your father's death certificate to the provider or collector ?
