Due to too many reasons to list, I have gotten myself in deep. I am 40 yrs old, make $55,000 per year and have over $93,000 in unsecured debt - primarily credit cards. I have consulted several consumer credit couseling agencies and the best they can do is cut $200 off the $1900 due per month. At my income, I can barely pay my living expenses and secured loans. I'm considering bankruptsy but don't want to lose my home which is nearly paid off (value - $28,000) or our second vehicle that is paid for. What is the best course of action for me now?

Talk to a BK attorney about filing a 13 to keep your home. You will most likely have to sell your second vehicle. Since you have a large debt a 13 may not even work out depending on the creditors positions. You can not have it both ways in discharging your debts and still keeping your assets that have equity.

My opinion is that you should file a 7 and start all over again since you make enough money and most of your debt is unsecured and would be discharged.

Yeah and its ****wads like you who when i NEED a lousy increase from $1000 to $3000 because my car died and i am collecting unemployment, and need a car to find a job, they turn me down.....

go bankrupt...you get no sympathy from me.
