turned over to collectionWhat is the name of your state? Montana I filed bk in Sept. Today I received a letter in the mail from a collection agency for one of the accounts I filed on, a Conoco fuel account. After filing I even received a letter from Conoco notifying me that they had received notice of my filing and were closing the account. Why would they turn this over to a collection agency when they are fully aware of the bk filing? I still have the letter they sent. Should I contact my lawyer about this first or should I go ahead and write a letter of dispute to the collection bureau with the supporting documents for the bk? |

| I'd do both. Tell your lawyer, that's what you're paying him for. The Collection letter is a violation of the automatic stay and/or the discharge (if you're there yet). I'd also write them a cease and desist letter, include your BK case number and discharge date if you have one, and tell them that if they don't quit, you'll file a Motion for Contempt with the Bk court for violation of the BK law !
