Question

Voidable settlement by BK Court


What is the name of your state? Arizona

Is a settlement agreement voidable by one party of a divorce if the agreement was entered into a year prior to BK court approval when the agreement restricts or inhibits the
party from being able to follow through and fund an ongoing Chapt 13 ??

From the sound of that question I would say you should contact a local attorney but I will say this: you might be better served in thinking about changing the Ch 13 plan. Or maybe try to get the Agreement amended in state court.

I think the answer to your question is - It is highly unlikely. Domestic Support Obligations are given very strong standing by the BK code.

But you might give more details about the situation to try and get a more solid response here. Start with: To what did the BK court give its approval? A Plan?
