Wage GarnishmentWhat is the name of your state? CA I have started making my CH 13 pymts back in Dec. My back taxes for IRS and FTB are paid thru the plan. Therefore, I stopped making pmts directly to them back in Oct (when I knew I would file ch 13). I recently received a notice from FTB saying they will garnish my wages 25% each pay check until the balance is paid. I faxed the notice to my lawyer, but my most recent paycheck on 2-15 has already been garnished the 25%. My lawyer told me to expect that 1st one to occur because of the timeframe with which I received the notice and my nect paycheck. My question is, will I get that money back, as I am already paying it thru the plan? |

| They were included in your plan and should have been notified of such. They should not have been able to garnish anything with the automatic stay in place. You should be able to get that money back and the garnishment stopped.
