What amount is not enough? What is the name of your state?NY I have debt that comes to about 30,000. Would it be ridiculous to file for bankruptcy? At this point in my life there doesn't seem to be any way to even begin to pay this off. I'm young and can't even get an apartment in my name because of this debt. Also what is a resonable cost for filing bankruptcy? |

Not ridiculous at all. I filed for BK with $30,000 of debt. And I paid exactly $1,274 to file which included both my attorney's fees and the mandatory filing fee of $274.

You had to pay this all up front and do you know if the cost depends on the state or if it got more expensive after the law changed?

The $274 filing fee is the same everywhere and that is an increase from what it was before the law changed. As far as the $1000--that is what my attorney charges. I did a fair amount of cold calling attorneys and in my area of NY state that was pretty much the norm for a reputable attorney. This particular attorney used to charge around $700 for a BK before the new law, but with all of the increased paperwork and increased liability for lawyers I think most attorneys raised their fees. And yes I had to pay the full amount up front (as well as a payment of $50 to a credit counseling agency) before I could file. Last edited by mperry60; 02-17-2006 at 10:22 PM.

What is your income? Also, some debts like student loans will survive bk.

My husband and I make about 24000 a year. I only have a few credit cards a repo'd car and a phone bill. No loans but I'm young and my husband refuses to help pay off the debt I had before our marriage and since he's the only one who works I don't really have a choice. I could get a part time job and try to pay it all of little by little but at that rate I will never have good credit again......

Well, given the amount of the debt and no income I'd say bk is your best bet. Thing is, post bk you really need a job. Filing bk does no good if you can't support yourself after bk.

Why should your husband pay for your pre-marriage debt? He didn't accumulate it, you did... You can file for any amount, doesn't matter... Post BK you will need to get "new" credit, and having a job, even part time would help you...
