What constitutes family in bankruptcy?


What is the name of your state (only U.S. law)? Ohio
I live with someone, a friend. We are NOT family at all, andeach own one half of a house. Can they claim we are a hosehold? or considered family. I am soley responsible for my debts,he does NOT want his social security check to be included as family or household income as I have no part in his money or his bills We just own the house together, he goes his way and I go my way.
so I dont want what he has to be included in my means test andwe want to keep the house not have it sold out from under us.

SS income is exempt from means testing. It will have to be disclosed but, he then backs out all of his expenses meaning, he has nothing to contribute to your debts.
Get yourself to a lawyer and get all of your options explained.

Family


Thank you for the answer, I was concerned about what the bankrupty court would consider as family. The friend said he did not want anyone questioning him about MY bankruptcy as he has nothing to do with what I own or owe and did NOT want to be invlolved as we only share a house equally but NO money or possesions. All the furniture, etc belongs to him.
He pays the house payment and I pay utilities and food. It was the only way ether of us could get a house. weboth live onsocial security checks but are joint owners of the house. So Could I alone file andnot have them ask him anything as he is NO family and contributes nothing to meexcept the housepayment, I pay my half of the house payment too.

Sorry, that's not how it works. Household income will have to be disclosed.
Ask him what he'd rather deal with-a few harmless questions about his finances or, the posssibility of a lein on the house if you get sued and lose?
