Question

When should my chapter 7 be finalized


What is the name of your state? Indiana

My husband and I filed chapter 7 in Sept of 06, then we went to court that December to face the trustee. Here it is, now September 4th 07, and still no discharge papers?!?! We keep calling our attorney, who, might I add, is worthless, and they continue to blame it on the trustee being overwhelmed by the district.....I'm ready to move on!!! Is this typical? What can I do about this??

If you just filed, you don't get discharged until the plan is paid off in 3-5 years.
Why would you be looking for a discharge when you just filed?????

I'd get a pacer accpunt and find out what's going on.

You could also call the clerk for the district in which you filed. I've seen a bankruptcy get put on the backburner for some reason and then forgotten about by the clerks office. Just have your case number ready when you call.

One other possibility: were you to send any additional documentation to the trustee?

I just wanted to let you know that I finally opened a PACER account, but I must say it's all a bit confusing......Looking over it I see the date we filed 11/06, then the trustee mistakenly closed it before we paid our tax money 3/07, so then it was reopened 4/07. That all makes since, but I also see were it says Proof of Claim 7/07, any idea what that means??

Well, since you had to surrender your tax refund, the POC just means a creditor filed a claim for their portion of the return.
I'd agree with Gregeney. Call the court clerk and ask for your case manager. They should be able to give you some info. Nothing you posted on the Pacer update looks bad. Sounds like you just got lost in the shuffle somewhere.

I hope I don't sound silly saying this, but is it the bankruptcy court I should be calling, or the courthouse here in town??? Stupid question I know, I just want to be sure

Thx Big, I really appreciate all your guys advice! This is so complicated & I wouldn't wish this on ANYONE! I'll keep you guys posted.
