who gets the tax return? What is the name of your state? New Mexico I filed for Chapeter 7 in October of 2005. My debts were discharged Jan 31, 2006. I have a fairly large tax return coming on 2005 taxes. There is no written or verble directive from the trustee as to wheather or not I keep the return or it goes to the trustee. Who does my accountent send the tax return information to? Who gets the return? Thanks |

A: You get the return. The trustee gets the refund.

| If the trustee wanted your refund, he/she would have said so. To be safe, ask your attorney. |

| If you are discharged, you get the refund assuming that you did not dodge this question on the Chap. 7 questionaire, and fully informed the trustee that you were owed money in the form of a refund by the feds. If you did not tell the trustee, ask your attorney. |
