Will my property be affected in any way if my wife files Chapt. 7 bankruptcy?


We live in Ohio. My wife currently owes almost $20K in debt. I myself owe around $30k due to a $25k student loan and misc. bills. Her credit is pretty bad already. Also, we have a little one that is on its way, so we would like my wife to file bankruptcy and get rid of her debt entirely. My question is if by her filing chapt. 7, will my property be affected in any way. Her name is not on anything I own at all. I have a house and some property in another state. Thanks in advance.

Assuming you qualify, based on the information you furnish here, your wife would not be required to list anything but her property and her debts on the petition.

Will my credit take a hit in any way? Will her creditors try and go after me to pay off some or all of her debt, considering I'm her husband? Will they try to take my property?

Your income will need to be disclosed but your expenses will be taken into consideration so it's usually a wash.
Ohio is not a community property state so you should have no liability for any of her debts.
