Alarm company contract


What is the name of your state? Texas

I recently bought a new house and it came with an alarm system. I signed a contract for 3 years with an alarm company for a set amount per month for the three year period. After about 7-8 months I noticed I wasn't setting the alarm and basically was wasting the $25+ dollars per month. I looked over my contract and it does state that the agreement was for three years, however there was no cancellation cause.

I called the company and said that I wanted to cancel their services. They said that I wasn't allowed to and that I had to stay with them for 3 years because of the contract. No where on the contract does it says anything about paying out the contract in case of cancellation, etc like most contracts do (cell phone companys etc). I argued with them & said there was nothing that states a cancellation clause, the way I read it was more that they would provide me with service for 3 years for $x.xx . After getting a manager involved they said I could cancel the service.

My wife sent in a the notice and they rejected saying that I signed the contract so I had to send it in. I then faxed it back in with all of their requirements and they still denied it. Now they state that I owe them for the last 6 months of monitoring even though they had agreed to cancel my services 6 months back and I still have the letter that I faxed to them. They continue to hound me and tell me that I owe them for 6 months of services, but I don't feel like I do. They have since sent my account to collections and they are now harrassing me for the money. I told them the story and even supplied them with the cancellation letter that I faxed to the alarm company. They responded with the contract and said that it was a 3 year contract and that I had to honor it. So, they are now saying if I don't pay they will put it on my credit report. What is my legal recourse?

Same issue


I have recently had avery similar situation with an Alarm company. Have you heard of any legal action to take. My situation was that 3 years was complete and I then wanted to cancel. Because I didnt notify them 60 days in advance They automatically renewed me for 1 year. Even after knowing I wanted to cancel. They now are threatening to send my account to collections.. I really feel like I am getting screwed. It does not seem right.
