What is the name of your state (only U.S. law)? California. What is the statue of limitations in California for sueing an Architecht in small claims? We reported him to the Architechs board of California and they are imposing a two thousand dollar fine on him. The board also suggested that we sue him in small courts to get our money back for the faulty work he did at our home. We reported him to the board based on principal, however, being that our claim was valid and we are unhappy with a home which we will have to pay for the next 30 years, we now want to get our money back from him. Thanks.

We signed the contract with the architecht in 2005 - however, because of the issues involving the work of the architech the plans were approved by the city in March of 2007

California Statutes of Limitation

Written agreements: 4 years, calculated from the date of breach.

I'm not sure what the date of the breach would be in your case. Is the amount you want to sue for really within the small claims court limit? $7500? Even if it is, you may want to consult a lawyer for advice before proceeding.
