We purchased a pickup truck in New Mexico from a private party (non auto dealer).
We were not told that the airbag in this vehicle had previously been deployed.
We discovered after the point of sale that the airbag had not been replaced.
New Mexico Motor Vehicle Dept. shows some requirements for sellers of autos to disclose missing or defective safety equipment.
Does a missing airbag fall under the requirements of a seller to disclose?
If we go to small claims court, would the seller be required to pay us for repair/replacement of the missing or defective airbag. Or, could we insist on a refund if we returned the vehicle?
