Purchased an Extended Warranty from Legend Autorama for 10 yr / 100,000 mile - Premium Care - zero deductible ... in Dec. 2002 for a 2003 Beetle.

Unbeknown to us ... 2 years later (oct 2004) they submit the warranty only to find it refused because the warranty written is not applicable for our year of car.

On their own - without our knowledge or permission - they purchased a 7-yr warranty. We only found out through a mailing from the insurance company on November 18, 2004.

Since November 18, 2004, we're trying to settle. Was finally offered a warranty of the same level (Premium / 0 deductible) for 7 years that would take us to 2012 - just a few months short of a 10 year warranty - and the refund of the cost difference in policies. We accepted the deal. Since then they (policy writer and company owner) have avoided us like the plague.

After dealing with BBB, and without contacting us (of course), Legend Autorama sent us a refund - ending the matter on their end. We have not cashed the check - looking for options because we want the deal they offered us.

We want the offer that was offered to us. Do they have a right to just dismiss us this way? What recourse do we have? Are they accountable for the warranty switch they made without our knowledge in October 2004?

Any help would be appreciated.
