I was divorced in 2000. In 2003 I moved to Arizona and bought a home with my ex-husband. The arrangement has not worked out as I'd hoped. I paid a large down payment and just discovered that the title is held in joint tenancy rather than tenants in common. The home has been appraised and has nearly doubled in value in the two years we've lived in it. Can anyone tell me what my options are and if the home was sold, would it be an equal split or could I recover the initial down payment?
