Best way to break a lease?

Hello,

I am being forced to move to another state due to the extremely high cost of living here or face eviction from where I am living. I live with my boyfriend who was laid off about a month ago, and we have been struggling ever since... now I can't make rent next month. I already work two jobs. Anyone have any advice to offer as to how to go about breaking the lease? There was no info in the contract that I could see that gave a penalty amount for breaking the lease... it was a year's lease, and we have been there for 3 months. Thanks!

It is strange there is no clause in the lease stating any penalties, usually they claim you must forfeit your security deposit and pay until it is re-rented.

I would suggest trying to see if you can find a replacement renter, the LL will also have to show good faith in mitigating damages by advertising for a new tenant. You may have to pay those costs as well. But as it is unless you can sublet ( which is dicey unless you go through assignment and novation) then you are going to be responsible for the rent until the unit is re-rented.
