If an error in bookkeeeping was made ie: A client was entitled to $25,000.00 as a settlement in a workmens compensation case.
When it came time to write the check the check was written for $28,000.00. The client cashed the check. The client was aware of te amount of the settlement he was due but cashed the check for the $28,000.00 anyway. The check was written out of an escrow Trust account. Who is responsible for returning the money to the escrow acount.
